How do i stand with ebay?

Hi guys after successfully bidding for some BR2 speakers, I have just received them via courier only to discover they are not BR2 speakers they are in fact Bronze B2 speakers they were advertised on the auction as BR2 speakers more than once also. They were described as....

MONITOR AUDIO BR2 SPEAKERS IN
BEECH. USED BUT WELL CARED FOR IN SMOKE AND PET FREE HOME. NO MARKS.
SUPPLIED IN ORIGINAL BOX WITH MANUAL.

AWARD WINNING SPEAKERS OFFERING GREAT SOUND. RRP £200

So my question is do you know how i stand with ebay or paypal? i.e. refund because these speakers are not BR2 speakers and i am more than a little annoyed to put it mildly.

There is a link on the help pages of ebay about using misleading descriptions for goods, think that would be the best place to start. It will also tell you to first contact the seller, most people are pretty good on ebay imho.

Yeah, I've had to do this before.

Try to contact the seller stating you wish for a refund and your reasons. IF he agrees, great. If not response or he does not agree, follow the links in PayPal - it works really well.

BR is the current model with different drive units...B2 is last-generation. Quite a bit of difference in sound as well, IIRC...

I would get in contact with the seller - he may well agree to some sort of compromise, and this is by far the best recourse.

Don't rely on Paypal - I had a recent spat with a seller who sold me a Mac with a non-legal version of OSX on it, but wouldn't send me proof of license and Paypal wanted me to get a written letter on letterheaded paper from a "specialist" that was going to cost me 1/3 of the cost of the mac to obtain. In the end I just gave up - they were totally useless.

Thanks for the advice but in terms of recourse, I am not looking for a compromise, like you say there is a difference in sound quality and I thought I was buying BR2 speakers. The annoying thing is though the two speakers look similar, you can distinguish the 2 apart and so I should have double checked also.

How many days do you think is reasonable to give the seller before getting in touch with paypal?

If you confidently explain to the seller that they have made a mistake and that Paypal will be involved unless you resolve it, they might just give you the money back. Paypal will side with you - post the item number and I will tell you for sure - I've had many disputes. The latest was someone selling a Chord Chameleon Silver Plus RCA cable. They advertised it as that, they posted a picture of the blue CCSP cable and stated that they bought it new 6 months ago for £125. It arrived and was black and the first Chord Chameleon and about five years old. They refused to see how they had done anything wrong but Paypal made them pay me back.

It's worth a go - I would say that 1 calendar week should be plenty for them to respond. Send another message after 6 days requesting a response within 24hrs, and if you don't get that, escalate to Paypal.

**EDIT** I've just noticed that you mention that the picture on the auction was actually of the B2s - if this is the case, you might have less weight with the argument. He's still in the wrong, of course, but it might make things trickier...

i didn't know they were B2's at the time as the once i have heard the BR2's i did not pay any attention to the speaker itself. However since there is a difference in looks, surely it doesn't weaken my case whatsoever? because he is advertising something as BR2 when it clearly is not.

I've only ever had one dispute with a guy who sent me copied games for the PSP instead of the originals he was advertising. After a couple of weeks of emailing the person and getting no reply, I contacted eBay who gave me their phone number. When I rung, I got through to his Dad (turned out the guy was only 14) who then refunded me - and no doubt gave his son a rollocking!

the only reason you may have a problem is that the picture is a true representation of the item -it is a picture of the item - it is what you have received.

i agree the title is misleading - hopefully will be nice seller and if you ask for refund and return the item he will pay up.

You could argue its his mistake for placing wrong title but also your mistake for not noticing the picture and title didn't match - i am also guessing you never emailed the seller before purchase - i always contact people to get them to confirm in writing to me condition - age - amount of use ect

they were good speakers when they werw released.

Well it looks like things are going to reach a welcome conclusion, he has apologised, said it was a mistake and is happy to provide a full refund to me. I think it was a genuine mistake, it's just I was really annoyed after having waited quite a while and then spent what I thought was a bargain amount on them lol. Oh well perhaps this might be a sign that I should simply buy them new.
