misold a product out of warranty

Hey I bought a graphics card which claimed to be HDCP ready but its not, I bought a new one and it works fine, so I know its the card.

XFX are saying its out of warranty in aug 2009, but surely if they said it was HDCP ready and its not the warranty would not apply am I right?

I cant seem to find anything in trading standards about this, but I paid 60.00 for the card 3 years ago, and have had to fork out another 40.00 for a proper HDCP card.

If you purchased the card 3 years ago you'll find it quite difficult to get anything back on it. It would be pretty hard to argue that at no time over the course of the 3 years of ownership it was fit for purpose but you could only ascertain this now after such extensive use.

For the amount of money you paid I'd chalk that up to experience. Looks like you had 3 years use out of it using it quite happily before you started to get into bluray playback. The card may have developed a fault. Also the card may actually be HDCP compatible but has problems handshaking with your kit. Most HTPC forums are littered with threads about HDMI handshake issues.
