Work related decision, should I take voluntary redundancy or accept dismissal on capability?

ok so ive been off work for 6 months with an injury, im awaiting treatment which may not come for another few months. I am in the process of mutually agreeing dismissal on grounds of capability, as I did't want to and couldn't afford to stay on sick till I get seen for treatment. The workplace has started that process by sending a letter for a medical report from my doctors but at this stage and just been informed that my company is looking for redundancies, I have been at the company for 3 years and I want to finish there for various reasons, my question is, would it be best for me to go out by dismissal on grounds of capability or being made redundant by voluntary redundancy? any good advice would be appreciated

...but they might still decide (rightly or wrongly) that your exit can only be on grounds of capability.

If you do get the choice, find out what payoff you might get from redundancy (statuary redundancy pay won't be much after 3 years).

It might look better to have finished due to having been made redundant, than because of being incapable....if you're bothered about what any future employer might think.

I would in the interim, if you're not already done so, seek sound advice from your union (get membership if you're not union member) and/or seek legal advice from a solicitor if you can afford one or Citizen Advice Bureau.

If you're young and you're likely to make a full recovery, and if the option is available (speak to HR), I would veer towards redundancy, that doesn't look bad on your record, better than termination due to incapacity to perform your duties, it's a difficult one because I'm only giving my gut feeling.

You should do the due diligence, get all the legal advice in terms of what arrangement would provide the best package and allow you to move on with your life.

Redundancy + Severance Pay > Termination payment package+ Compensation (if any) ??
