Can i cancell my order or not?

Hi there, i thought i ask this question because i am not sure where i stand on this. I went to my .local SEVENOAK'S sound and vision store last week and auditioned a PIONEER SC-LX82 a/v amp and a MONITOR AUDIO BR5 5.1 speaker package and i was quite happy with the sound quality of both the amp and speaker's and the manager told me how much it was going to cost and i came in the next day and paid him the full amount in cash but when i went home and looked on the INTERNET i was gob smacked to find that i could have saved over £300 if i had bought of this PETER TYSON store on line. So the next day i went back to SEVENOAK'S and told them that i changed my mind and if it would be possible to cancel the order and have my money back but the manager said that i had no ground's in canceling the order and that i would haver to go ahead with the sale, i also told him that this particular on-line store were selling the same component's but £300 cheaper but he said that he could do nothing, so i was quite gutted and i had to go ahead and in buying the good's off them. What i need to know is that is the manager right in saying that i could not cancel my order only 2 day's afterword's because i am surprised that there is no cooling off period. Please let me know if i did have any ground's in canceling the good's or not. Thank's

Sorry, I don't think you have any grounds for cancelling your order as the DSR don't apply in your case as you have bought in person from a shop.

You're only chance is if the manager is prepared to give way as a goodwill gesture.

Generalising broadly, cooling-off periods only exist on deals done over the pohone, the internet, or if a salesman comes to your house. You went to their shop and bought something from them, so it doesn't apply.

The question of whether you should use a bricks-and-mortar dealer as a free service to audition something which you then subsequently buy off the internet is another matter altogether.

Pretty poor service that they would not refund you the difference considering its the same shop.

Pretty poor service that they dont have a no quibbles refund policy within like 7 days.

seems like they said ha ha we got your money so stuff you.

Will make me think twice before buying from them thats for sure.

Why don't you simply tell the manager that the store's own website has advertised it for less? I'm sure he will oblige. If the goods have not been delivered to you, I would think you still have a right to change your mind.

Yes, but nobody has forced him to buy and don't forget he went away and went back the next day to purchase.

Very true laserman.

I would have listened to the speakers, and if I liked it, would have seen if its cheaper elsewere then went back to the shop and asked them to match the price, if not buy on-line.

But that does not help him now

Change of mind

Unfortunately you have no right to a refund or replacement if an item is simply unwanted. The main exceptions are if the seller specifically agreed to a refund or exchange on return of the goods and for certain home shopping purchases which can be cancelled from the day on which the contract is concluded until seven clear working days after receipt of the goods. In practice, many stores operate a 'goodwill policy' and will exchange unwanted goods or refund you, providing the item you are taking back is in the same condition it was when you bought it.

Maybe he should have checked online before and not after.

Sorry i did not make it very clear on my original post but the on-line retailer was another retailer ( PETER TYSON) and not another branch of SEVENOAK'S. I suppose the SEVENOAK'S store's cannot sell that cheap because they have more over head's rent etc also i did get the chance to audition first but what really ****** me off was the manner in which the manager handled all this affair. I reckon people should have a no quibble seven day refund especially if the good's are still in the shop and have not been delivered.

Well you have entered into a contract with the shop which they have accepted.
 
Well, you've had a demo, didn't you? How can you expect Sevenoaks to pricematch an online retailer after you've had the luxury of a proper demo which the online retailer (Peter Tyson) couldn't provide? That's a bit cheeky!

I'm not surprised that Sevenoaks' manager got irritated. Imagine these brick & mortar retailers offering you everything they can to help you arrive at a decision, & then you turn around asking to pricematch an online deal (and that too after paying up). They just won't survive this competition.

peter tysons are a very well respected company with two brick and mortar stores in carlisle, cumbria, one for av the other for hifi, so i expect their overheads are just as large as a sevenoaks store and they have less buying power. i do agree with the sevenoaks manager tho in this case, its highly unlikely you were going to go to carlisle for a demo

Should have lied if you wanted out. Told the guy you'd just been made redundant and couldn't afford the items any more. Underhand, yes, but may have got you out of it.
