Advice sought, what should i do about this damage to blu ray player?

Hi guys I bought a 37 panasonic PX80 and a BD30 blu ray player as part of a package deal. However when I opened the blu ray player box I discovered the following

1. Box was resealed not factory sealed.

2. Some components have been resealed not factory selead.

3. The player is used, light scratch marks, dirt in the disc flaps ect. Also side screws are marked as if it's had a repair.

4. Serial number on the box does not match the one on the player.

5. The serial number on the instructions does not match the one stamped on the player.

6. No 1 year guarantee registration booklet, so no warranty cover if needed.

Now I should add that none of this was mentioned in the description, I have rang up the retailer and they have apologised for this and said they didn't realise. They simply had a blu ray player out in the stock room which they bundled with this tv. Now in fairness they haven't been completely difficult, they have given me two options, a replacement with a BD10 or a full refund. Now the latter I certainly don't want because this is an excellent tv but equally the market value of the BD10 is far less than the BD30. They have said to me they don't have any more BD30's left so a straight swap is not possible and a swap for a BD35 is not possible because of the cost of the BD35.

So any ideas guys?
 
I think you have a few options, one you good ask for a refund and depending on your budget, or what you payed for the package go get the new Panny range. Ask if you can pay the difference between the two, or ask how much they will give you if you send it back, failing all that then ebay. Now mistakes are made and most trading companies usually offer some discount for defects, it's worth kicking up if your not happy.
 
Hi thanks for your reply, they said that a discount was not possible because when they advertised the tv and blu ray player initially they advertised it as a buy it now on ebay for another 100.00 more than what I paid for it. In addition they told me that when they advertised it originally it had a damaged pedestal which they replaced. The message from them was I had a very good tv and blu ray player fo an excellent price and while they could refund me fully or exchange for a BD10, they were not willing to talk about discounts.

Where did you buy it from? An online retailer, an auction site or from an online retailer through an auction site or a shop?

I would take the offered refund & look for one some where else.May be just me but it would annoy the hell out of me,maybe i'm on the cynical side & would be thinking that someone was trying to con me.

I've had a quick look at the item on Ebay - the TV is advertised as ex-display but not the BD player.

Whether or not the price was £100 more as a buy it now item, they made it available and sold it to you as an auction item and are legally bound to the sale and for each item to be as described.

I've not seen or heard of a BD10 - is this a BD player? I wouldn't be swapping for a lesser player if it is lower spec than the one I'd bought without an incentive as well. I've just seen a BD30 for sale as a buy it now for £169 and a BD35 as a buy it now for £199. £30 difference - offer to pay that difference for a brand new BD35.

They appear to be members of RETRA so I'd consider writing to them also.

Thanks for that, yeah basically the BD10 was the first blu ray player panasonic released in 2007. Originally they were selling the item as a buy it now but because of a lack of interest, they changed it to an auction. .
 
I am really glad you asked about the spec of the BD10 now, it has made me do some research and I have found out that the BD10 didn't support 24fps!.

Not a problem - has made me feel loved.

The BD35 is basically the same model as the BD30 other than it's newer. That would be my minimum swap. I'd be prepared to pay a nominal fee for an upgrade to a BD60.

Keep talking to the dealership to see what can be worked out. They'd appreciate your sale to be a happy one than none at all I'd imagine.

If you write to RETRA, inform Crampton and More politely you will be writing, don't use it as a threat as in - 'if you don't give me a,b or c I'll be writing to RETRA...' Let them know you'll be writing to both Ebay and RETRA as goods were not as described and you are having problems rectifying to both parties satisfaction and copy Crampton and More into each correspondence.

You may find they are willing to negotiate either a: a further discount on your purchase or b: a swap to another player of equal specification plus a cash sum to allow for difference in price.

As I see it your choices are quite simple, Crampton and Moore have made a ligitimate mistake in not advertising the BD player as Ex-display as they did with your TV and are adehering to EBAY rules by offering you a refund if you are not happy with the goods that you won in the EBAY auction or feel that they have in anyway miss-represented the good in their auction discription.

The TV and BD player were sold as one item so their end it is down to what both items owed them as to the price they can afford to sell them at, you did not buy the TV and BD player in seperate auctions so they are under no presure to refund either seperatly only both. This is a risk you take buying thing off of EBAY and especially when it comes to "Ex-Demo" equipment.

Now I have personally delt with Crampton and Moore on more than one occasion and have always found them very helpfull and above all honest so personally I believe the not discribing the BD30 as USED as the honest mistake they have said it is, so you cna either take the full refund that they have offered you or keep what you have if you are happy with the price you have paid taking into account both the TV and BD player are used.
 
To clarify, it is not so much that the player might have been ex display, to be honest that doesn't bother me. What bothers me is the noticable scratches, the serial numbers not corresponding, all are tell tale signs that this is graded. I have spoken to them 3 times today lol and yes from speaking to the guy whose name is Richard it seems that it was a genuine mistake. I accept that part about it but felt like I shouldn't be expected to make do with something that was graded. I finally thought we had reached a good solution, basically they were going to pick up the blu ray player, give it a once over, replace the casing and replace the screws. However that has now been thwarted to lol because panasonic no longer provide the casing for this particular model. I have only just heard this and in light of this development they have offered to credit me 50.00 off the total sale.

What do you think about this offer?
