xbox 360 are thay 1.3 hdmi????

I think they are 1.2.

I know it is 1.2 on the Elite so would therefore think it would follow suit on the other versions of the console.

Yes, the Xbox can bitstream DD5.1 over HDMI but that has nothing to do with the HDMI version. Check the FAQ at hdmi.org or bluejeanscables.com that explains exactly what was added with each revision of HDMI.
